Innocents caught up in porn piracy suits

First it was music, now it's porn. Attorneys for the adult film industry are taking a page from the music industry and filing mass lawsuits to stop porn piracy. They say the illegal file sharing is cutting deeply into profits, and those who play without paying must be stopped. Problem is, Innocent people are getting swept up in the internet dragnet.

Bobbie Jean Thomas, 78, says she is one of them. The disabled senior lives in Richmond with her daughter, who runs a daycare center in the shared space. Thomas says she was shocked and scared last year when she received a letter from her internet service provider saying they were being subpoenaed to release her name because her account's IP address was linked to illegal file sharing.

"I know I didn?t do it, I hardly know how to turn the computer on," Thomas said. "It?s very ridiculous. If I were downloading anything it probably would?ve been some gospel music."

Thomas says she then received a letter from attorney Ira Siegel of Beverly Hills, threatening to sue her for the downloading and sharing of a copyrighted adult film. She's not the only one. NBC Bay Area also spoke with a woman who lives near Austin, Texas, who shared a similar story. She asked not to be named, but says she and her husband, an Iraq war veteran, were accused of file sharing a lesbian porn flick. "On the actual date and time [of the alleged download], we were sitting on the couch watching the "Survivor" finale with our 12-year-old child." She says there's "no way" anyone was illegally sharing porn from her Internet account. She also adds, "We have a password protected, non static IP address."

These two women are just two examples of what attorney Mitch Stoltz calls victims of "copyright trolls." Stoltz is a staff attorney specializing copyright and intellectual property law for the San Francisco- based Electronic Frontier Foundation.

"They don?t really care who they?re targeting; they don?t really care whether people have actually infringed their clients? copyrights or not," Stoltz said. He says the so-called "trolls" use special software to identify IP addresses they suspect of stealing copyrighted materials. Then they file mass lawsuits against thousands of ?John Does? threatening to sue unless the defendant agrees to settle for a few thousand dollars.

"A lot of times they?ll say 'pay us and we?ll go away,'" said Stoltz.

But Las Vegas attorney Marc Randazza, who represents a major adult film company, says in the 30,000 cases he?s pursued ? only 4 of the accused were innocent.?

"These companies now will put out a DVD or a movie online and within 24 hours they will find 20 to 30 thousand pirated copies," says Randazza. He says the lawsuits are working to cut down on porn piracy. "We have found since we started this lawsuit campaign that piracy has gone down on my clients? materials 75 to 80 percent and we have found revenue has gone up. Less people are stealing it, more people are buying it. The right thing is happening."

Randazza is not one of the attorneys involved in the suits . But he insists the number of innocent people who are scared into settlin is tiny. "I think that happens as often as you see a unicorn.? People don?t pay because they didn?t do it. People pay because they did it or it wasn?t them and it was somebody in their household," he says.

Bobbie Jean Thomas says she has no idea how she ended up as a defendant, but insists she is innocent. With the help of her goddaughter, a paralegal, she filed a motion to quash the lawsuit. Nearly a year later, a judge dismissed the entire suit. "I was very relieved," says Thomas. "I?m too old to go to jail for a movie I didn?t even see."

We contacted Beverly Hills based attorney Ira Siegel, and law firm Prenda Law, who is behind the lawsuit involving the Texas woman who spoke to NBC Bay Area. They declined to comment on the cases involving the women in our story.

There are a few things you can do to protect yourself from being named in this type of suit. First, don?t download and share copyrighted material without permission. Second, make sure your internet connection is password protected. That won't guarantee you won?t be named in a lawsuit, but it will prevent other people from using your wifi connection for illegal activity. And if you do receive a letter accusing you of illegally downloading something you didn't find a copyright attorney to help you. The Electronic Frontier Foundation has a list of attorneys who have offered to help people at reduced or no charge.

Airbus to build 1st US assembly plant in Alabama

MOBILE, Ala. (AP) ? Airbus says it will build its first assembly plant in the United States in Alabama.

The official announcement Monday gives the European aerospace giant its first foothold in the U.S. to compete with archrival Boeing. The plant will make passenger airplanes.

The plant is expected would cost $600 million to build and will employ 1,000 people when it reaches full production. It will be built in Mobile.

Boeing has employed hundreds of people in Alabama for years. Airbus had planned to build in Alabama previously to manufacture refueling tankers for the U.S. Air Force. But its parent company, the European Aeronautic Defense and Space Co., lost the contract to Boeing in 2011.

The companies have had a long-running international trade dispute. Each also has been critical of subsidies received by the other.

Organic tomatoes contain higher levels of antioxidants than conventional tomatoes, study suggests

ScienceDaily (July 3, 2012) ? A study conducted at the University of Barcelona shows that organic tomatoes contain higher levels of phenolic compounds than conventional tomatoes. Phenolic compounds are organic molecules found in many vegetables with proven human health benefits. The UB's Natural Antioxidant Group, headed by lecturer Rosa M. Lamuela, had previously demonstrated that organic tomato juice and ketchup contain higher polyphenol content than juice and ketchup made from conventionally grown tomatoes.

Lamuela points out that during the production process of ketchup and juice, there are lower levels of polyphenols; therefore it was necessary to verify that the differences observed in previous studies had their origin in the tomatoes themselves and not in the technology used during the production process. As lecturer Lamuela states, "it must be verified with raw material."

Polyphenols -- natural antioxidants of plant origin -- are considered to be of great nutritional interest because its consumption is associated with reduced risk of cardiovascular and degenerative diseases, and some forms of cancer. The team behind the study has analyzed a variety of tomato called Daniela and has determined its phenolic profile by using liquid chromatography coupled to mass spectrometry. With this method, the research group of the UB could identify 34 different phenolic compounds in tomatoes. According to Rosa M. Lamuela, "the benefit of taking polyphenols through foods is that they contain a wide variety of such molecules, which are increased." This would be more beneficial to health than the intake of supplements. Tomatoes also contain lycopene and other carotenoids, and vitamin C. Hence, according to Lamuela, "they contain many beneficial compounds."

Organic or conventional crops?

Differences between organic and conventional tomatoes can be explained by the manure used in both cases. "Organic farming doesn't use nitrogenous fertilizers; as a result, plants respond by activating their own defense mechanisms, increasing the levels of all antioxidants," explains the first author of the article, Anna Vallverd? Queralt. "The more stress plants suffer, the more polyphenols they produce," points out lecturer Lamuela. Numerous scientific investigations show that the consumption of these antioxidants has numerous health benefits. Researchers claim that more studies of clinical evidence are still needed to be able to state that organic products are truly better for our health than conventional ones. Lamuela would like to carry out a study with humans comparing organic and conventional tomato consumers.

Also participating in this research, published in the Journal of Agricultural and Food Chemistry, are researchers Olga Ja?uregui, from the UB's Scientific and Technological Centres (CCiTUB), and Alexander Medina Remo?n, who, together with Rosa M. Lamuela and Anna Vallverd? Queralt, are from the UB's Department of Nutrition and Bromatology, from the Reference Network on Food Technology of the Government of Catalonia (XaRTA) and from the Institute for Research on Nutrition and Food Safety (INSA-UB). This research group is also affiliated to the Spanish Biomedical Research Centre in Physiopathology of Obesity and Nutrition (CIBERobn) and RETICS networks, from Carlos III Health Institute.

Seagate Backup Plus


In a world teeming with portable hard drive choices, Seagate's GoFlex line is noteworthy for its versatility and sprightly performance. As successor to the venerable GoFlex line, the newly-minted Backup Plus line represents Seagate's next wave of drives. But not all successors are successes, and the new Backup Plus (1TB) ($139.99 direct) has some big shoes to fill. How does it fare? As it turns out, quite well. With brisk performance, a smart user interface that uniquely incorporates social networking, and its versatile USM (Universal Storage Module) adapter, the Backup Plus is a fully realized product that ultimately outshines the GoFlex line and, accordingly, is the rightful heir of the Editors' Choice for portable hard drives, previously held by the Seagate GoFlex Turbo (750GB) ($169.99 list, 4.5 stars).

Design and Features
Measuring 0.5 by 3 by 4.75 inches (HWD) with the USM (a proprietary interface) adapter (and 0.5 by 3 by 4.4 inches without), the Backup Plus's compact chassis is complemented by its tasteful, low-key aesthetic. While our test unit was black, it also comes in silver, blue, and red. Constructed entirely out of plastic, its primary visual flourish is the brushed faux-metallic finish on the lid, with the Seagate logo on its lower right side. While I prefer the sturdiness of a metallic drive along the lines of, say, the Western Digital My Passport Studio (1TB) ($179.99 list, 4 stars), the Backup Plus is nonetheless a handsome drive that, at either 5.4 or 5.9 ounces (depending on whether the USM adapter is attached), can easily slip into a laptop bag without adding any noticeable heft.

The real draw is the USM adapter, which securely fastens to the rear of the drive in the same manner as the GoFlex line. As was the case with the GoFlex Turbo, the USM adapters are available for USB 3.0 (tested), FireWire, and Thunderbolt. While some may find fault with having to shell out the extra cash for additional adapters, it's nonetheless a cheaper option than purchasing a new drive altogether, not to mention the added convenience of using the same drive rather than transferring your data over another for the sake of employing a different connection method.

Once you plug the drive into a PC, you see a revamped version of Seagate's Dashboard program. The new Dashboard was clearly designed with simplicity in mind, as its clean interface presents three options: Protect, Share, and Save. The Protect category allows users perform a back-up manually or automatically, as well as create customized back-up plans. The Dashboard's true gem lies in the Save category, where files uploaded to a Facebook or Flickr account are either manually or automatically stored in a folder within the Backup Plus. Sure enough, after posting some test snapshots to my Facebook wall from my smartphone, they showed up in my Backup Plus. It's an innovative and simple method to store all your pictures or videos on a single location. The Dashboard's Share feature is somewhat less impressive, as it simply allows you to upload files from your Backup Plus directly to your Facebook account. While I typically appreciate the notion of skipping the Facebook interface to upload images, this function is not nearly as impressive as the Share feature.

The Backup Plus comes formatted for NTFS but can be reformatted for Macs. The only shortcoming in this regard is the "Protect" feature of the Dashboard, as it's not Mac-compatible. This isn't necessarily a fatal flaw since Mac users can perform the same task via Time Machine. Mac users can still utilize the rest of the Backup Plus's abundant set of features. In comparison, the Clickfree C6 Portable (1TB) ($150 street, 4 stars), is not compatible with Macs.

Performance
Although the drive we received from Seagate came equipped with USB 3.0, Seagate's USM adapters come in three flavors?FireWire, Thunderbolt, and USB 3.0. Using USB 3.0 (via the USM adapter's Micro B Port), the Backup Plus outpaced every portable drive in its class. It copied our 1.22GB test folder in a blazing 15 seconds, sprinting ahead of the Clickfree C6 (17 seconds) as well as the GoFlex Turbo (750GB) (18 seconds). Although a difference of a few seconds may initially seem negligible, the distinction becomes more pronounced when multiple large files are transferred. The Backup Plus's USB 3.0 speeds resoundingly trumped the WD My Passport Studio (1TB) using FireWire (31 seconds). Although USB 2.0 predictably yielded slower speeds for the Backup Plus (40 seconds), its USB 2.0 speed nonetheless surpassed that of the WD My Passport Studio (44 seconds) and the Clickfree C6 (41 seconds).

In the PCMark05 test, the Backup Plus yielded remarkable scores of 6,463 (via USB 3.0) and 3,125 (via USB 2.0), handily edging out the GoFlex Turbo's USB 3.0 score (6,025). The Backup Plus likewise yielded excellent results in the PCMark7 test, finishing with 1,449 (via USB 3.0) and 1,244 (via USB 2.0), easily edging out the Clickfree C6 Portable's scores of 1,406 (via USB 3.0) and 1,232 (via USB 2.0). The GoFlex Turbo's PCMark7 score of 1,498 with USB 3.0 was the lone instance in which the Backup Plus was outpaced, and since it was by a scant 49 points, it amounts to little more than a light drizzle on the Backup Plus's otherwise triumphant parade.

While the Seagate Backup Plus bears the imprimatur of the GoFlex line, its numerous attributes prevent it from standing in the lengthy shadow cast by its formidable GoFlex forebears. With its better user interface, faster performance, and innovative incorporation of social networking, the Backup Plus manages to outshine its predecessors, and sets the standard for future drives in the process, earning our Editors' Choice for portable hard drives.

Nokia promises back-up plan if Windows Phone fails

Nokia has a contingency plan in place should the Windows Phone operating system fail to take off, according to the company's new chairman.

The fate of Microsoft's rapidly-improving OS and the Finnish hardware manufacturer are intrinsically linked to each other as both companies look to gain a foothold in a market dominated by Apple and Google.

Nokia has thrown most of its eggs into the Windows Phone basket, while Microsoft has made it perfectly clear that Nokia is its preferred partner to push flagship devices.

Should all that fall apart though, recently-appointed Nokia chair Risto Siilasmaa told the YLS Uutiset website that plans are afoot to ensure the company's survival.

He was still quick to assure that faith in the success of Windows Phone is still very strong, but it seems Nokia could be preparing for the worst.

What's the back-up plan?

So what could be Nokia's Plan B? It's not a return to Symbian, that's for sure. Siilasmaa admitted that the previously dominant software now has a market share of "close to zero."

Would a Windows Phone failure finally see Nokia leap into the caring arms of Google's Android operating system? Many would argue that had Nokia chosen that path three years ago, then it wouldn't be in a position to worry about its future in the first place.

The company is currently facing up to the prospect that its flagship, and mightily impressive, Lumia 900 device may soon be obsolete due to the lack of an upgrade path to Windows Phone 8.

Tough times in Finland.
