Theft of game hens could cost Ark. sheriff his job (AP)

LITTLE ROCK, Ark. ? An Arkansas prosecutor says a sheriff isn't qualified to do his job because he pleaded guilty to stealing Cornish game hens more than three decades ago.

Prosecuting Attorney Cody Hiland filed a petition Monday asking for Searcy County Sheriff Kenney Cassell's removal from office. Hiland says the theft of Cornish game hens is "an infamous crime" that bars Cassell from holding office.

Cassell pleaded guilty to a misdemeanor crime in 1979. He was sentenced to 30 days in jail and ordered to pay a $300 fine.

Cassell says his guilty plea shouldn't bar him from office because voters knew about it when they elected him last November. He admitted to the theft in a paid political ad in a local publication.

(AP) ? Unprecedented drug shortages are threatening the lives of cancer patients and other seriously ill people, and the Obama administration's plan to tackle them is but a small step toward solving a complex problem.

President Barack Obama ordered the Food and Drug Administration on Monday to take new steps to send out early warnings about looming shortages and try to avert them.

"Even though the FDA has successfully prevented an actual crisis, this is one of those slow-rolling problems that could end up resulting in disaster for patients and health care facilities all over the country," Obama said.

There's already a crisis in the eyes of many frustrated doctors and hospitals who are scrambling for supplies of medicines ranging from common chemotherapies, to anesthetics used in surgery, to the electrolytes that are crucial to IV feeding in intensive care. Fifteen deaths have been blamed on shortages. Patients have had treatments delayed, surgeries canceled, or had to use second-choice medications. Hospitals are reporting price-gouging ? such as a drug that usually costs $26 being offered for $1,200.

Sometimes, "you have to look the patient in the eye and say, 'I can't treat you. I certainly can't treat you the way I meant to treat you,'" said Dr. James Speyer, medical director of the clinical cancer center at New York University Langone Medical Center.

"That's a terrible thing to have to do, and it's happening across the country," added Speyer, who said Obama's action is important but doesn't address one key part of the problem ? drug profits. "Unfortunately, we're going to be living with the problems of these shortages for some time."

It's unthinkable to patients who find themselves caught in the mess.

"How in the United States of America could critical lifesaving or life-prolonging drugs be in short supply?" asked Jay Cuetara, 49, of San Francisco, whose said chemotherapy to hold back his advanced cancer recently was delayed by a week when his hospital ran out and couldn't get more. He joined Obama in the Oval Office Monday as the president signed an executive order directing the FDA's next steps.

Just how big the shortage is depends on how you count, but this is a record-setting year. The FDA reported 178 drug shortages last year and says it sees more this year. The University of Utah's Drug Information Service reports higher numbers: 232 shortages this year, up from 211 last year. The Utah service tracks shortages for the American Society of Health-System Pharmacists, and has documented a tripling of the problem over the past five years.

Recent shortages could have been even worse: The FDA said Monday it had prevented 137 more drug shortages in the past two years, when companies told regulators they were having trouble. Options include getting other manufacturers to ramp up their own production, helping to find alternative suppliers of key ingredients, sometimes even allowing temporary importation of competing drugs sold only abroad.

Obama's executive order instructs the FDA to take more such steps ? to push more companies to come forward about potential shortages, to speed applications to change production of those drugs, and to alert the Justice Department about possible collusion or price-gouging.

The administration also supports legislation pending in Congress that would go a step further and require more industry reporting of shortages,

Overwhelmingly, the drugs in short supply are injectable medications used mostly by medical centers. They're usually generic drugs, not pricier brand-name versions. Just half a dozen companies are the main suppliers, said University of Utah pharmacist Erin Fox. A number of those factories have had to close for safety or quality upgrades in recent years, and there have been some shortages of ingredients bought abroad.

An Obama administration analysis concluded a big part of the problem is rising demand, especially for cancer drugs, that those companies haven't been able to boost production to meet.

But, "the main cause of drug shortages is economic," argued Dr. Thomas J. Smith of Johns Hopkins' Sidney Kimmel Comprehensive Cancer Center and Virginia Commonwealth University pharmacist Mandy Gatesman in this week's New England Journal of Medicine.

Reimbursement for administering IV drugs is a percentage of the average sales price, what they call an incentive to prescribe a pricier version. Also, manufacturers want to produce versions with a higher profit-margin. Consider that shortages of a common cancer drug named leucovorin didn't start until the FDA approved a similar competitor that worked as well but, because it was new, was 58 times more expensive, the pair wrote.

The Generic Pharmaceutical Association said it would work with FDA.

But FDA Commissioner Margaret Hamburg acknowledged her agency can address only part of the problem.

"There's no single or simple solution," she said. Still, "we can make a very real and meaningful difference by expanding our network of early warnings."

The executive action is part of a larger push by the White House to portray Obama, who is facing re-election, as an effective counterpoint to congressional Republicans blocking his jobs legislation. Last week, he issued an executive order to help homeowners refinance at lower mortgage rates and to allow college graduates to simplify and lower their student loan payments. On Friday he directed government agencies to shorten the time it takes for federal research to turn into commercial products in the marketplace.

The Republican National Committee called Monday's order "political expediency," noting that shortages have made headlines for much of Obama's presidency.

More school districts looking at school finance lawsuit ? Off the Kuff

Trustees of the area?s two largest school districts ? North East and Northside ? on Tuesday deliberated about joining a lawsuit against the state over what some consider to be an inadequate and inequitable education funding system.

Houston attorney David Thompson, who plans to file a lawsuit, one of several expected over the issue, spoke to trustees of both districts during separate board meetings Tuesday night.

San Antonio, Harlandale and South San Antonio school districts have already joined a lawsuit filed by the Texas Taxpayer & Student Fairness Coalition.

Thompson plans to argue in his lawsuit that once the Legislature adopts standards to meet the state?s constitutional education requirements ? such as setting college readiness goals and standardized testing expectations ? the state is obligated to fund those mandates.

But because legislators cut school funding by $5 billion this year, Northside cut its budget by $61.4 million and NEISD cut its by $28.4 million.

?Did the Legislature order the highway department to go build roads and bridges that weren?t funded? Of course not,? Thompson said to NEISD trustees. ?I wouldn?t want to drive on that bridge. Why would we do that to our kids??

Thompson said that while the Equity Center lawsuit may draw more districts, he expects his lawsuit to represent more students. The Equity Center lawsuit has drawn more than 285 districts, according to a news release. Thompson said about two dozen districts have joined his lawsuit thus far. East Central ISD is also discussing it.

Depending on their student population, districts could pay up to $65,000 to join Thompson?s lawsuit, which he expects to file in mid-November.

Thompson?s lawsuit is the one that HISD voted to join. Austin ISD has joined the Texas Taxpayer & Student Fairness Coalition/Equity Center lawsuit. They will probably be joined at some point, along with a third lawsuit that will allege that the state is imposing an unconstitutional statewide property tax again, which was what the West Orange-Cove lawsuit was about. In the meantime, it?s a little confusing to keep track of them all ? I now realize that I had thought HISD voted to join the Equity lawsuit, not the Thompson one. So many reasons to sue, so little time. Anyway, NEISD and Northside have not made a final decision yet, but I expect they?ll jump in.

Hidden Drivers of Childhood Obesity Operate Behind the Scenes

Anxiety around children's eating habits often peaks during sweets-laden holidays like Halloween, but the factors that contribute to excess weight in kids extend well beyond special occasions. Most children who are obese?now 17 percent in the U.S.?will carry that extra heft into adulthood, along with the long-term health consequences. Scientists project that today's generation of children will live shorter lives than their parents and have higher rates of heart disease, diabetes and atherosclerosis. Despite diverse efforts?from First Lady Michelle Obama's Let's Move campaign to the U.S. Department of Agriculture's MyPlate nutrition guidance changes?the number of overweight and obese children does not seem to be dropping, which has sent scientists searching for other drivers of the childhood obesity epidemic.

One group at the University of Illinois at Urbana?Champaign is enlisting experts from fields as wide-ranging as genetics and communications to try to untangle the intricate web of forces that yields a profusion of pudgy kids. "It's cellular makeup, it's child behaviors and child attributes, it's family behaviors within communities and environments within state and national level policies," says Kristen Harrison, founder of the university's Synergistic Theory and Research on Obesity and Nutrition Group (STRONG) Kids project. "It's incredibly complex." Factors such as heredity, access to exercise, parental food habits and cultural differences in portion sizes are all known to contribute to childhood obesity.

And these factors do not exist in isolation. "What we don't really know yet is how those factors interact with each other," Harrison says. And recently researchers at STRONG and elsewhere have started uncovering additional, surprising drivers of obesity, such as sleep schedules and the frequency of family meals.

More to diet and exercise
Getting kids to eat healthfully and get more exercise might sound simple, but the long list of genetic, cultural and environmental factors that lead children to these behaviors are complicated and interconnected, and scientists have just started to understand them in the past few years.

Fresh fruits and vegetables, for example, are not always accessible. Some communities have plenty of grocery stores that stock fresh, healthy foods, whereas other neighborhoods have only fast-food chains and corner convenience stores, making it difficult to get enough healthful items. "A family may be really motivated, but if it takes two bus rides to get to a store that carries fresh produce, it's hard," Harrison says. Outside the family sphere, children are also often confronted with a wide variety of pound-packing options in vending machines and even in school lunches.

Budget cuts at schools have also cut back on sports and physical education programs, reducing the amount of exercise kids get during school hours. And a lack outdoor play spaces like parks and woods can also hamper parents' good intentions. "Parents who live in neighborhoods that aren't safe, aren't going to send their kids to play outside," Harrison says. And an indoor lifestyle makes it difficult for children to get enough exercise to keep their weight down?or lose weight that they currently have.

The researchers are also quick to point out that all the blame cannot fall solely on parents either. "Often people say, 'Well parents, just stop feeding your kids so much,'" Harrison says. "There's an attitude that people are stupid, they're greedy, they don't care. And that couldn't be further than the truth." When parents in low-income communities are asked about nutrition, they know the right answers, he says. They know that their kids should be eating more fruits and vegetables, and less fast food. "So there's something way beyond just education."

Television watching, for example, turns out to be a better predictor of bad eating habits than does parental weight, race and income, and a child's gender and ethnicity?together?according to a study by Harrison and her team. This is probably prompted by child-targeted food marketing, combined with a sedentary lifestyle and snacking while watching. One study published in the Archives of Pediatrics & Adolescent Medicine in 2006 estimated that for every hour of daily television, kids consumed an additional 167 calories.

Deeper drivers
Parents, schools and even family doctors might be pardoned if they have neglected to consider some of the newly described factors that might be behind childhood obesity. In one study unconnected with the STRONG Kids Project, researchers in Australia set out to study how sleep might affect weight. They found that, contrary to their expectations, it was not the amount of sleep that mattered, it was timing, says Carol Maher, a postdoctoral research fellow at the University of South Australia and lead researcher on the study. Children who went to bed early and got up early were far healthier than those who went to bed late and got up late, even though the two groups got the same amount of sleep.

It could be that those who go to sleep later spend more time watching television. Mornings tend to be better for exercise, whereas evenings are prime computer and television times?which means less exercise, more snacking, and more exposure to food marketing. But, Maher points out, it could also mean that kids who are more physically active during the day tend to get tired earlier, and go to bed earlier.

How often kids eat with their families also might impact childhood obesity rates?one group found that every meal not eaten with the family each week predicted an 8 percent increase in the likelihood that a child would be overweight. And health benefits of home-cooked meals might not be the only reason for this correlation, Harrison says. The simple act of a reliable family meal could also be adding psychological stability. Kids who feel like they have a support system and can manage their emotions tend to be healthier overall. Family mealtimes often provide parents a place to spot behavioral warning signs for depression or other unhealthy stressors.

Harrison hopes data from the STRONG Kids program will help policymakers examine the blind spots in current strategies. Because the drivers of childhood obesity are complex, solutions will have to be so, too, she says. Instead of tackling one factor, "they'd be double-barreled and triple-barreled policies," she says. For example, she said, policies that affect schools could address several of the causes of childhood obesity, such as access to vending machines, physical activity requirements, and even teaching students healthier habits. "If you attack a bunch of the influences at once," Harrison says, "you're going to get a much more powerful effect."

Europe bailout fund chief courts China (Reuters)

BEIJING (Reuters) ? The head of Europe's rescue fund sought to entice China on Saturday to invest in the facility by saying investors may be protected against a fifth of initial losses and that bonds could eventually be sold in yuan if Beijing desires.

Klaus Regling was in China to persuade Beijing to stump up money and help the euro zone beat its two-year-old debt crisis. He said the European Financial Stability Facility (EFSF) may invest in a special purpose vehicle and absorb the first 20 percent of losses.

Regling did not say whether China had asked for that degree of protection and declined to comment on his meetings in Beijing. But he said he expected to submit a proposal on how to scale up the 440-billion-euro ($623.7 billion) EFSF rescue fund by November.

Expanding the EFSF to 1 trillion euros is key to the euro zone's latest anti-crisis plan, put together at a Eurozone summit this week. Details on how this would be done have yet to be finalized and European leaders are under pressure to show the plan would work.

"The EFSF will take a certain tranche that will be a junior tranche, which means if something goes wrong, the first loss will be carried by the EFSF. It could be around 20 percent," Regling told students at the Tsinghua University.

Regling, chief executive of the EFSF, said the fund could sell bonds in yuan in future if Beijing so desired. But he said that would be difficult to pull off right now.

"We have so far only issued euro bonds but we are authorized to use any currency we want if it seems efficient," he said.

"It also depends on the Chinese authorities, whether they would approve that. I think it is probably more difficult. But I could imagine that over the years it might happen."

WHY CHINA SHOULD BITE

Regling was visiting cash-rich China two days after euro zone leaders struck the deal to boost the firepower of the EFSF, recapitalize banks and reduce Greece's crippling debt burden.

French President Nicolas Sarkozy immediately got on the phone to China after the summit to seek financial help, saying Beijing had "a major role to play."

Europe has said the EFSF may be expanded either by offering insurance to buyers of euro zone debt in the primary market, or via a new special purpose investment vehicle that it hopes would draw funds from China and Brazil, among other countries.

The deal has left major economies Italy and Spain under pressure. Italy's borrowing costs jumped at a bond auction on Friday. Prime Minister Silvio Berlusconi was forced to promise reforms to quash speculation that his government was about to collapse.

Regling made clear he wanted to determine what it would take for Beijing to put more money in the EFSF. But he hinted it was also in China's interests to have a healthy euro and an alternative to the dollar as a reserve currency.

"Many particularly large economies in the world want to have ... the euro as part of the international monetary system. That is a good reason to support our program," Regling said.

When asked why Beijing should buy more euros and risk currency losses if the bloc launches another round of quantitative easing, Regling said the European Central Bank had been prudent in growing its balance sheet, compared to the U.S. Federal Reserve and the Bank of England.

"I can assure you should invest in the euro, this is not the problem," he said. "The ECB has only one objective -- price stability and they will deliver."

Stuck with elevated inflation, China worries that ultra-loose monetary policies abroad will further stoke price pressures at home. It has repeatedly scolded the United States for its quantitative easing, deeming it "irresponsible."

BEIJING CAUTIOUS

Some analysts agree that China has far more upside than downside in providing support for Europe, not least in protecting its global trade. But it may drive a hard bargain to part with some of its $3.2 trillion foreign exchange reserves, the world's largest.

Beijing is, nonetheless, cautious. Although China has expressed confidence that Europe can survive its crisis, it has made no public offer to buy more European government debt.

The careful stance was underscored on Friday by Vice Finance Minister Zhu Guangyao, who said Beijing was awaiting details on new investment options for the EFSF before deciding its next move.

Regling also acknowledged that China would take no hasty decisions and said he expected no concrete outcome from his visit.

He shrugged off any notion, in his discussions with students, that the euro zone project could unravel, saying that the currency bloc remained united.

"There is no political intention to kick out any country," he said. "It would not be in the interest of any countries, not economically, not politically."
